Development of Disability
Standards for Education 2005 (the Standards) has
been underway since 1995. The Standards are
intended to give students with disabilities the
same rights as other students.
The Standards aim to overcome
discrimination based on stereotyped beliefs about
the abilities and choices of students with
disabilities. Under section 32 of the DDA,
education providers must comply with the
Standards.
To comply, an education
provider must make reasonable
adjustments to accommodate a student with a
disability. Education providers are under a
positive obligation to make changes to reasonably
accommodate the needs of a student with a
disability.
To achieve this, the
Standards give students and prospective students
with disabilities the right to education and
training opportunities on the same basis as
students without disabilities. This includes the
right to comparable access, services and
facilities, and the right to participate in
education and training unimpeded by
discrimination.
If a person considers there
is a breach of the Standards, then they can make a
complaint to the Human Rights and Equal Opportunity
Commission to conciliate, it can be terminated by
the Commission and proceedings can be instituted in
the Federal Court of Australia or the Federal
Magistrates Court.
